These Terms of Service ("Terms") govern your use of the Phantom Coder desktop application and website (the "Services") operated by Phantom Coder ("we", "us", or "our"). By using the Services, you agree to be bound by these Terms.

The Service

Phantom Coder is a desktop application that uses AI to analyze on-screen content and provide real-time coding assistance. The application runs locally on your macOS device and communicates with our servers to process requests.

Accounts

You must create an account to use the Services. You are responsible for maintaining the security of your account credentials. You may not share your account with others or allow multiple people to use a single subscription.

Subscription and Billing

Access to the full Services requires a paid subscription at $99 per month, billed monthly through Stripe. Your subscription renews automatically until you cancel. You may cancel at any time from your account settings — cancellation takes effect at the end of your current billing period.

We reserve the right to change pricing with 30 days' notice. Price changes apply to the next billing cycle after the notice period.

Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the application
• Redistribute, sublicense, or resell access to the Services
• Use the Services to develop a competing product
• Attempt to circumvent rate limits, authentication, or other security measures
• Use the Services in any way that violates applicable law

Your Responsibility

You are solely responsible for how you use Phantom Coder and any consequences that arise from that use, including in the context of job interviews, assessments, or examinations. We provide a tool; how you choose to use it is your decision and your responsibility.

No Guarantees

We do not guarantee any particular outcome from using the Services. AI-generated solutions may contain errors. You should always verify solutions before presenting them. We are not responsible for interview outcomes, employment decisions, or academic results.

Intellectual Property

The Phantom Coder application, website, branding, and all related materials are our property. Your subscription grants you a limited, non-exclusive, non-transferable license to use the application for its intended purpose.

Termination

We may suspend or terminate your account if you violate these Terms or engage in abusive behavior. Upon termination, your right to use the Services ceases immediately. You may also terminate your account at any time by canceling your subscription and contacting us to delete your data.

Limitation of Liability

To the maximum extent permitted by law, Phantom Coder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the website at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance.
